Terms and conditions
Version 2026-10-23.2, last updated 23 October 2026.
These terms are a contract between you and OML LTD of Mauritius (“OML”, “we”, “us”) for the use of OML Send. You accept them when you tick the box as you sign up; we record the date and the version you accepted. If you sign up for a business, you confirm you may bind it, and “you” then means the business, its owners, admins and every team member it adds.
1. What OML Send does
- OML Send is a tool. It sends what you prepare (your list of people, your texts and your files) to the numbers you give, from the WhatsApp number you connect, at a pace you can see before you start.
- We do not choose who receives a message, we do not write or check what it says, and we do not check that a file is the right one for a person. The checks OML Send shows (a number that is not a mobile, an ID not found in a PDF, the same file twice) are aids, not a guarantee: they can miss a mistake.
- OML Send is not affiliated with, endorsed by or sponsored by WhatsApp LLC or Meta Platforms, Inc. WhatsApp is a trademark of WhatsApp LLC; we use the name only to say which service your messages go through.
2. Your own WhatsApp account, and the risk that it is blocked
- You connect your own WhatsApp account. OML Send links to it as a linked device (like WhatsApp on a computer), through open-source software that WhatsApp has not made or approved. You remain bound by WhatsApp's own terms and policies, which WhatsApp sets and may change. Those terms do not allow automatic or non-personal sending from a normal account unless WhatsApp authorises it, and WhatsApp has said it may take legal action against those who do it or help others do it. You decide whether to connect a number, knowing this.
- WhatsApp can block or limit your number at any time, at any volume, and may take other action against your account. OML Send sends slowly, one message at a time, and its health check slows down or pauses sending when it sees some warning signs, but it cannot see them all. We do not promise and cannot promise that a number will not be blocked or limited, and we are not responsible if it is, nor for any other action WhatsApp takes against you. If you connect your main business number, you could lose WhatsApp on that number for good, with its chats. You connect a number at your own risk; before pairing you confirm that you have read the notice that says so.
- The speed OML Send uses depends on how long you say the number has been used; if what you say is not true, the higher risk is yours. If you choose a speed above OML Send's standard speed, a block is much more likely: you confirm that choice for each campaign, and it is recorded.
- WhatsApp's official Business Platform, with your own Meta business account, is the channel WhatsApp approves for business messages. It has its own rules, approvals and costs, and numbers on it can also be limited. OML Send does not offer it yet.
3. What you send is your responsibility
- You alone are responsible for your lists, the numbers and names in them, the consent of the people you send to, what your messages say, the files you attach, and the checks before sending, including those made by your staff and team members.
- For every campaign you tick a disclaimer before it can start, and it is recorded with your name, the time and its version. For “each person gets their own file” it says: I and my staff have checked every person, number and file. OML sends the file shown against each person, with our message, to the number we gave. OML is not responsible for a wrong number, a wrong file or any other mistake in what we uploaded, matched, checked or approved. These people agreed to receive their documents from us on WhatsApp, and where a document holds health information, we have the lawful basis the law requires to send it this way. For “one message to many people”: I have checked the list and the message. These people know my business and agreed to hear from us on WhatsApp, and each message tells them how to say STOP. OML sends exactly what I prepared and is not responsible for my list, my message or mistakes made by me or my staff. These statements are part of these terms.
- You confirm that each person agreed to receive documents or messages from you on WhatsApp, or that the law otherwise allows it, and that your marketing messages go only to people who agreed or did not object, with a clear way to say STOP.
- Every message must make clear that it comes from your business: never hide or disguise who a message is from. You must not use OML Send to send spam, unsolicited adverts or messages to people who did not agree to hear from you; to send to numbers you bought, collected from the internet or obtained without permission; to send anything unlawful, false or misleading, threatening, harassing, hateful, obscene or infringing, malware or links to it, or anything that harms children; for fraud or phishing; for political or election campaigns; or for anything that needs a licence or approval you do not have.
- We accept no responsibility for a wrong number, a wrong file, a message sent to the wrong person, or any other mistake made by you or your staff. You will compensate us for any claim, fine, loss or cost (including reasonable lawyers' fees) we suffer because of your lists, the consent of the people on them, what you sent, or because you used OML Send against these terms or the law, including sending spam or unlawful content. We tell you of such a claim promptly and let you take part in the defence.
- If we are told, or find, that a campaign breaks these terms or the law, or puts your number, other customers or OML at risk, or if WhatsApp, a court or an authority asks us to, we may pause or stop it, delete it and suspend the account. When it is urgent we do this first and tell you why as soon as we can, unless the law does not allow us to. We cooperate with the authorities where the law requires it.
4. Opting out
- A person who replies STOP, or a similar word such as ARRET, ARRÊT, STOP PUB or UNSUBSCRIBE, is put on your workspace's do-not-send list and is not sent to again by your workspace. We keep that list as a keyed code of the number, never the number itself, also after your campaigns are deleted, so the opt-out holds; deleting the workspace deletes the list. Replies written another way may not be caught: read the replies on your phone.
- You must honour every other request to stop that you receive, and you must not try to get around the list.
5. Personal data: our processing agreement with you
The lists and files you upload hold personal data, sometimes health data. For this data you are the controller and OML is your processor under the Data Protection Act 2017. This section is our processing agreement.
- Your instructions. We process the data only to send your campaigns as you set them up, to show you their counts and receipts, and to keep your opt-out list; never for our own purposes, never sold, and never shared except as this section says. Only the OML staff who run the service can reach the server, and they are bound to keep what they see confidential.
- Special-category data. Health data (lab reports, for example) is special-category data. You confirm you have a lawful basis to process it and to send it this way, and that you told the people concerned what the law requires.
- Security. On our server, every campaign's people, numbers, names, IDs, texts and files are stored encrypted with a key of their own, which is kept apart from the data and left out of our backups. Connections to OML Send are encrypted. While a message is being prepared and sent, the server handles its text and file unencrypted for that moment.
- Your linked number. While your number is linked, the messages it sends and receives, and the contact and chat updates WhatsApp sends to linked devices, also reach our WhatsApp gateway, as they reach any linked device. We use them only for delivery and read receipts, replies to your campaigns and STOP requests. The gateway is set up not to store messages, contacts or chats; unlinking deletes what it kept to stay connected.
- Deletion. You choose per campaign: deleted 24 hours after it ends (the default), as soon as it ends, or at once with Wipe now, which also stops sending. A campaign never started is deleted 7 days after its last change. A campaign paused and not resumed is deleted 7 days after it was paused. Deletion destroys the campaign's key, so what is left of that campaign on our server and in our backups can no longer be read. Messages already sent stay in your WhatsApp, on your phone, and with the people who received them: OML Send cannot delete those. We keep only what billing needs (the campaign's id, channel, dates, how many messages were sent and charged) and the opt-out codes.
- Your people's rights. We help you answer a person who asks to see, correct or delete their data, and to object. Most of it you can do yourself, since the data is yours and short-lived.
- Breaches. If personal data of yours is affected by a security breach, we tell you without undue delay, with what we know, so you can meet your own duties.
- Hosting and others. Our server is rented from Contabo GmbH (Germany) and sits in a data centre in the European Union, outside Mauritius: your campaign data is stored and processed there, encrypted as above. Apart from that hosting company we use no other company to process your campaigns, and we will tell you before we add one, so that you can stop using OML Send if you object. Messages travel over WhatsApp as part of your own WhatsApp account, under your agreement with WhatsApp.
- At the end. When your account ends, everything of your campaigns is deleted as above. We do not return lists or files: keep your own copies.
- Proof and lawful instructions. We give you the information you reasonably need to show that this section is respected, and we tell you if we believe an instruction of yours breaks the Data Protection Act 2017.
6. Your account and team
- Give true details, keep your password secret, and tell us at once if you think someone else used your account. You are responsible for what is done with your account, including by the team members you add and the roles you give them.
- You must be 18 or older and use OML Send for your business, with your own customers, not for private use.
7. Credits and payment
- Each email address gets 20 free messages once, to try OML Send. After that, messages are paid, in Mauritian rupees, at the price shown when you buy them. Bought messages can be used for 12 months after the payment.
- One message is one text, with or without one file. Credits are held when you press Start, charged when WhatsApp accepts a message, and given back for numbers not on WhatsApp, failures, and anything cancelled or wiped before it was sent. Messages already sent are not refunded, unless the law says otherwise or the failure was ours.
- We may change prices for future purchases, and we tell you before a change applies.
8. Fair use and security
Do not try to break into, overload, copy or reverse-engineer OML Send, get around its limits or its pacing, or reach other customers' data. Such acts may also be offences under the Cybersecurity and Cybercrime Act 2021.
9. Availability
We work to keep OML Send available and safe, but we do not promise that it will always be available or free of faults, or that a message will reach a person or be read. We may pause sending for maintenance, security, or to protect numbers.
10. Our liability
- OML Send is provided as it is. As far as the law of Mauritius allows, we are not liable for a blocked or limited number or any other action WhatsApp takes against you or your account, for messages not delivered, for mistakes in your lists, texts or files, for indirect or consequential loss, or for lost profit, business or data. Our total liability for all claims is limited to what you paid us in the 12 months before the claim, or Rs 5,000 if that is more.
- Nothing in these terms limits liability for fraud (dol) or gross negligence (faute lourde), or any right the law gives you that cannot be excluded.
11. Ending
- You may stop using OML Send at any time; the workspace owner can delete the workspace in Settings.
- We may suspend or close an account that breaks these terms, does not pay, or puts others at risk. If we close it for that reason, we refund the messages you bought and did not use, less any amount you owe us under these terms.
- We may stop OML Send, or sending from your own number, at any time, for example if WhatsApp, a court or an authority requires it, or if we can no longer run it safely. We give you as much notice as we can, and we refund the messages you bought and did not use.
12. Changes to these terms
We may update these terms. We show the new version in OML Send or email you at least 14 days before it applies (sooner only when the law, WhatsApp or security requires it), and for an important change we ask you to accept it again. If you do not agree, stop using OML Send.
13. Law and disputes
These terms are governed by the laws of the Republic of Mauritius. If there is a problem, contact us first and we will try to settle it with you. If we cannot, the courts of Mauritius have jurisdiction.
